Balearic Islands Autonomy Statute: Key Articles

Article 4’s Own Language: Institutions in the Balearic Islands ensure the normal and official use of both languages, take steps to ensure their knowledge, and create the conditions to reach full equality of the two languages in terms of the rights of citizens of the Balearic Islands.

Article 8: Territorial Organization: The autonomous territorial organization articulates its islands and municipalities. The institutions of government of the islands are island councils and councils of the municipalities.

Article 56: Functions of the President: The President of the Balearic Islands appoints and dismisses the members to form the government, directs and coordinates its action, and holds the highest representation of the autonomous region as well as regular status in the Balearic Islands. The President, after consideration of the governing council, may refer the matter to parliament regarding his confidence on a program or policy statement. Trust is considered given when you vote in favor of a single majority. If parliament denies the confidence, the President presents his resignation to parliament, whose chairman shall, within fifteen days, convene the plenary session for the election of a new president of the autonomous region in accordance with the procedure laid down in Article 54 of this statute. The President is politically responsible to the parliament, which may demand government accountability through a motion of censure. The President, having considered the advice of government and on his own responsibility, may dissolve the parliament; the dissolution decree sets the election date.

Article 59: Lodging Appeals: The government can bring remedy of unconstitutionality, create conflicts of jurisdiction, and appear before the constitutional court in the course and terms provided in the Constitution and the Organic Law on the Constitutional Court.

Article 61: Island Councils: These are the institutions of government in each of the islands and carry out the government, administration, and representation of the islands of Ibiza, Formentera, Mallorca, Menorca, and the islands adjacent to them.

Article 79: Self-Administration: Corresponding to the autonomous community of the Balearic Islands is the creation and organization of self-administration within the framework of general principles and basic rules of state law and this statute.

Article 87: Own Right: In matters of exclusive competence of the autonomous region, the proper law of the Balearic Islands is applicable in their territory in preference to any other.

Section 133: Tax Agency: Management, collection, clearance, and inspection of their own taxes transferred to the tax agency of the Balearic Islands.

Fourth Additional Provision:

A. State-assigned fully tax: gifts and inheritance tax, wealth tax, property transfer taxes and stamp duty, taxes on gambling, taxes on retail sales of certain hydrocarbons, imposed on certain transportation, electricity tax.

B. Partially ceded total taxes: income tax of natural persons, tax, oil tax, tax on manufactured snuff, alcohol tax and the resulting beverages, beer tax, tax on wine and fermented beverages imposed on intermediate products.
