Construction Agents: Roles and Responsibilities

Meaning: Construction agents encompass all individuals, whether natural or legal persons, involved in the building process.

The Promoter

  1. Any person or entity, public or private, who decides, promotes, and supports the building work for themselves or for subsequent delivery to third parties.
  2. Duties:
    • To hold the title to the site and possess a law authorizing construction.
    • Provide necessary documentation prior to project drafting and authorize the project manager and subsequent amendments.
    • Obtain licenses and permits.
    • Issue documentation to the purchaser of the work.

The Designer

  1. The agent designer is commissioned by the promoter and, subject to technical standards and relevant planning, drafts the project. May prepare sub-projects or complementary parts. Each designer assumes ownership of their project obligations.
  2. Duties:
    • Possess academic and professional qualifications meeting exercise requirements.
    • Comply with current regulations and contract provisions.
    • Agree with the promoter on the recruitment of partial contributions.

The Constructor

  1. The constructor is the agent who, under contract with the promoter, commits to implementing human and material resources for the works or part thereof, subject to the project and the contract.
  2. Duties:
    • Perform the work according to the project, applicable law, and the instructions of the project manager and director of project execution.
    • Possess the title.
    • Designate the head of work.
    • Assign human and material resources appropriate to the work’s importance.
    • Sign the layout or start and the minutes of receipt of the work.
    • Facilitate necessary data to the project manager.

The Project Manager

  1. The project manager is the agent who directs development work in technical, aesthetic, urban, and environmental aspects, according to the defined project, building permit, and other authorizations.
  2. They should address the works of other subprojects.
  3. Obligations:
    • Possession of qualification.
    • Check the layout and the adequacy of the foundation and structure.
    • Resolve contingencies that occur during the work.
    • Develop possible amendments to the project.
    • Sign the minutes of staking or the commencement of work and final completion certificate.
    • Develop and execute the documentation of the work executed to deliver to the promoter.

Director of the Execution of the Work

  1. The head of the execution of the work is the agent who assumes the role of lead technical implementation of the work material and construction control and quality of the building.
  2. Obligations:
    • Possession of qualification.
    • Verify the reception of work by ordering the testing.
    • Direct the execution of the work material by checking the stakeout, the materials, proper execution and arrangement of building elements and facilities.
    • Include precise instructions in the Book of Orders and Assistance.
    • Sign the minutes of staking or the commencement of work and final completion certificate.
    • Collaborate with stakeholders in the preparation of documentation of the work performed, providing the results of monitoring executed.

Institutions and Quality Control Laboratories of the Building

  1. These entities control the construction quality of those trained to provide technical assistance in verifying the quality of the project, materials, execution of the work, and facilities.
  2. The testing labs are trained to provide technical assistance through testing.
  3. Duties:
    • Provide technical assistance and deliver the results of their commission to the agent author.
    • Justify that they have implemented a system of quality management that defines the procedures and test methods.

Suppliers of Products

  1. They are the manufacturers.
  2. Construction product that is manufactured for permanent incorporation in a play.
  3. Duties:
    • Perform deliveries of products to the specifications of the order, responding to their origin, identity, and quality, as well as compliance.
    • Facilitate use and maintenance instructions.

The Owners and Users

  1. Owners’ obligations include keeping the building in good condition with proper care and maintenance, as well as receiving, storing, and transmitting the documentation of the work performed and insurance and guarantees it to have.
  2. Users’ obligations include the proper use of the buildings.
