Multiculturalism and the Spanish Constitution

The Constitutional Recognition of Multiculturalism.

Many parts of the constitution allude to the existence in Spain of a plural reality of languages and cultures through the use of the word “culture”:

  • Preamble, fourth paragraph: “The Spanish nation … to protect all the peoples of Spain and Spanish …, their cultures and traditions, languages and institutions.”
  • Section 143.1 “… bordering provinces with common historic, cultural, and economic characteristics …”
  • Article 46: “regulation of the historical, cultural, and artistic” as “material culture” of the peoples of Spain “… the public authorities shall guarantee the preservation and promote the enrichment of the historical, cultural, and artistic heritage of the peoples of Spain …”
  • Existence of a plurality of languages, fourth preambular paragraph, art. 3, art. 148.1.17, and Disposal in art. 20.3 “… pluralism of society of the various languages of Spain”
  • Section 149.2 State as the nation’s central organization at the service of culture “… The State shall consider the culture as a duty and an essential” …

Policy rests on these pillars, ethnic or collective conception of culture in the Spanish Constitution.

Approach to the Nations Doctrine

As a nation (all powers come from the people, that is the nation’s …), biological-racial, and national structure-proletarian …. As can be seen the term people is a polysemic concept whose meanings depend on features specific to the voice has to fulfill in the text that is used.: People as a political unit, as a cultural unit as masses.

Middle Ages: Designate those groups possessing a common origin with a possible lineage.

Objective elements around nation: ethno-racial, linguistic and cultural history. Subjective elements: national consciousness.

The concept of “political nation” can really appreciate a national border, a creation of the state with the capacity to guide the authorities in the creation of a nation over the uniqueness of different ethnic groups or peoples who live in the state space. The political nation has great potential to become a cultural nation, these feelings, perceptions, common cultural forms come to clot as awareness of cultural identity.

The Notion of Nationality

Gives its name to two different realities: connecting a person with a given state political organization. Designates those added human capacity to cope with political leadership in the formation of the state.
