Roads State Authority

Article 153: State Authority

Roads under state authority are roads that constitute the road network within each state, excluding national roads that are in it.

Authorization Within the Right of Way

Article 154: Approval for Activities

All construction, repairs, installation of utilities, and related activities carried out within the strip of the right of way of national roads by public or private entities require the approval of the Ministry of Popular Power with competence for land transport.

Obligation to Repair

Article 155: Post-Work Road Conditions

Public or private agencies authorized to perform work or fixed-installation utility on the tracks shall leave them in the same or better condition than they were before the intervention, all in accordance with the provisions of this Act and its regulations.

Alternative Routes

Article 156: Free Transit Assurance

The National Public Power will ensure users free transit on the road network operated by the regime, whether through grants or direct administration.

Alternative routes are those that are built, maintained, and expanded by the competent authorities in those cases where they have granted a concession for a highway or road, in order to ensure that users can exercise their right to free movement without having to pay any consideration in exchange.

Serious Penalties

Article 169: Fines for Traffic Offenses

A fine of ten tax units (10 UT) shall be imposed on those who commit the following offenses:

  1. Driving vehicles without obtaining a license or the corresponding professional title.
  2. Neglecting traffic light signals.
  3. Driving without having passed the technical, mechanical, and physical review of the vehicle within the proper time.
  4. Driving a vehicle exceeding the allowed speed limit.
  5. Driving having exceeded the maximum time allowed for ground transportation of public passengers and cargo.
  6. Circulating ground transportation vehicles for public or private persons and cargo movement through channels not allowed for such vehicles.
  7. Driving while physically incapacitated to do so.
  8. Driving under the influence of alcohol, narcotics, or psychotropic substances.
  9. Driving in a way that endangers another vehicle clearly marked for use by people with disabilities or one operating in a driving school.
  10. Performing driving maneuvers prohibited by the regulations of this Act or by the competent authority on roads.
  11. Driving a vehicle without control devices, equipment, or accessories required for use relating to security, or when such attachments are defective or do not meet performance standards and other technical characteristics prescribed in the regulations of this Act.
  12. Driving while using communication equipment, except for hands-free devices.
  13. Driving vehicles that do not meet the National Standards System Quality, without prejudice to the provisions of this Act’s regulations.
  14. Providing false information to the National Register of Vehicles and Drivers, and to the competent authorities intervening in cases of violations of this Act and in traffic accidents.
  15. Driving public land transport of passengers or cargo in any of its forms without being duly authorized by law.
  16. Providing land transport service for a fee in any of its forms, in units unfit or being banned from circulation.
  17. Running any type of activity or work which affects circulation and traffic safety without permits granted in accordance with the provisions of this Act’s regulations.
  18. People who, in the exercise of authority, order the placement of signs and traffic control devices or make land boundaries that do not comply with established national and international provisions to that effect.
  19. Damaging, altering, or circumventing traffic control devices, or placing or replacing them without the permission of the competent administrative authority.
  20. Not using seat belts, or ensuring that other occupants of the vehicle utilize them.
  21. Owners or drivers who amend or alter the elements and safe manufacturing of vehicles without proper authorization.
  22. Owners of public land transport vehicles for people and cargo not having installed speed recording devices, or performing any act aimed at eliminating or altering their normal functioning.
  23. Fleeing the scene after being involved in a traffic accident.

The fines provided for in this Article shall be applied without prejudice to any other sanctions or administrative measures provided for in this Act.
