Spanish Social Security Benefits

Temporary Disability:

  • Requirements: Affiliated, registered or similar situation.
  • Common Illness or Non-Work Accident (MC or AnT): 3 days no pay, 4th to 15th day: 60% by company, 16th to 20th day: 60% by Social Security, 21st day+: 75% by Social Security.
  • Work Accident or Occupational Disease (MP or AT): 75% by Mutual Insurance Company.
  • Daily Base (BR): BCCCma/30

Permanent Disability:

  • Partial Permanent Disability (IPP): 33% reduction, can continue working. BRx24 (one-time payment).
  • Total Permanent Disability (IPT): Cannot perform fundamental tasks. 55% BR, can work in another role. 75% at age 55.
  • Absolute Permanent Disability (IPA): Cannot work. 100% BR.
  • Severe Disability (GI): Absolute incapacity, needs assistance. IPA + 45% to the caregiver.

Maternity and Adoption:

  • Contributory: Affiliated, registered, and contributions paid (-21 no requirements, 21-26 90 days in 7 years or 180 lifetime, +26 180 days in 7 years or 360 lifetime). 100% BR. 16 weeks + 2 for multiple births.
  • Non-Contributory: 100% IPREM (€537.84). 42 days + 14 days if large family.

Paternity:

  • Affiliated, registered, and contributions paid 180 days in 7 years or 360 lifetime. 100% BR. 4 weeks + 2 days from the 2nd child.

Pregnancy and Lactation Risk:

  • Affiliated and registered. 100% BR paid by MATEPS.

Death and Survival:

  • Widowhood: Social Security pays to the spouse. 52% or 70% if with family responsibilities or no income source. If AT or MP, 6 months of BR (one-time payment).
  • Orphanhood: -21 years (-25 if not working) 20% BR (52% if due to AT or MP).

Retirement:

  • (2012-65 years: 35 years for 100%, 15 years of contributions / 2027-67 years: 37 years for 100%, 25 years of contributions)

Unemployment:

  • Affiliated, unemployed, 360 days of contributions in 6 years, and commitment to activity. First 6 months 70% BR, rest 50% BR. BR=BCCC 6 months.

Worker Rights (English)

A. Tasks of Workers:

  • Drive public transport.
  • Respect traffic signals.
  • Have B, C, and CAP licenses.

D. Weekly Rest Days:

Yes, they have the right to 14 days of rest as per article 37.2 of the Workers’ Statute.

E. Vacation Days:

  • Workers with family responsibilities have priority in selecting holidays.
  • They have 30 calendar days of vacation per year.
  • Vacations are established between the company and worker representatives, following rotation and harmonization within service demands.

G. Extra Month’s Pay:

  • They have 3 extra payments per year: March, July, and Christmas.
  • The March payment is paid on March 15th, accruing from January 31st to December 31st of the previous year.
  • July and Christmas payments are paid on July 15th and December 15th, respectively.

O. Additional Information:

If a driver’s license is suspended while driving for the company, and an accident occurs, the driver will continue to receive their salary and may be assigned another job.
