Traffic Regulations in Urban Areas: Key Articles

Article 7: Powers of Localities

Management and control of traffic on urban roads. Regulation by Municipal Traffic. Immobilization and removal of vehicles on urban roads. Authorization of sporting events as it passes wholly and exclusively in town for testing. Urban determination of the degree of intoxication on urban roads. Closure of roads when necessary.

Article 20: Rates of Alcohol in Blood and Expired Air

Drivers of motor vehicles and bicycles may not drive on roads subject to traffic laws with a blood alcohol concentration exceeding 0.5 g/l, or alcohol in expired air exceeding 0.25 mg/l.

Vehicles intended for the transport of goods with an MMA of more than 3500 kg, vehicles intended for the transport of travelers with more than 9 seats, or public service vehicles, school transport and children’s vehicles, dangerous goods vehicles, or emergency service or special transport vehicles, the rate shall not exceed 0.3 g/l, or alcohol in expired air exceeding 0.15 mg/l.

Drivers of any vehicle may not exceed 0.3 g/l or 0.15 mg/l during the 2 years following the granting of their permit or driver’s license.

Article 21: Research on Alcohol: Persons Liable

  • All drivers of vehicles and bicycles.
  • Other road users where they are involved in a traffic accident.

Law enforcement officers may refer to these tests:

  • Any road user or driver of a vehicle possibly having been directly involved as a responsible party in a traffic accident.
  • Those driving any vehicle with obvious symptoms that denote events or facts that may reasonably assume that they do so under the influence of alcoholic beverages.
  • Drivers alleged to have committed any of the infringements of the rules contained in this Regulation.
  • Those who, when driving a vehicle, are required for this purpose by the authority or its agents within the programs of preventive controls for alcohol ordered by the authority.

Article 67: Priority Vehicles

Emergency service vehicles, public or private, when in the service of that character. May move above the speed limit and be exempt from other rules or signs in the cases and under the conditions specified in this section. Only when traveling on an express service delivery and take care not to violate the right of way at intersections of roads or traffic lights, without taking extreme precautions to ensure that there is no risk of collision with pedestrians and drivers of other vehicles have stopped running or are ready to provide your own.

Article 70: Non-Priority Vehicles in Emergency Service

Will endeavor to warn other users of the particular situation in which it circulates, using the buzzer intermittently and activating the emergency light, or shaking a handkerchief or similar procedure. They must respect the traffic rules.

Article 119: Exemptions

They may drive without seat belts or other approved restraint systems:

  • Drivers carrying out reversing maneuvers or parking.
  • Pregnant women, when they have a doctor’s certificate.
  • Persons holding a license certificate must submit an exemption when required by any law enforcement officer responsible for traffic.

Reached when moving in town, but never on motorways, highways, or conventional roads:

  • Taxi drivers, when they are on duty.
  • Distributors of goods, when making successive loading and unloading of goods at points close to each other.
  • Drivers and passengers of vehicles in emergency service.
  • Persons accompanying a student or apprentice during driving lessons or aptitude tests and are responsible for additional controls of the automobile.

Persons with an exemption certificate signed by a physician are exempt.
