Less Severe Penalties

Article 170. Shall be punished with fines of five tax units (5 UT), subject to the penalties provided in this and other laws, those who commit the following offenses:

  1. Driving without plates or plates identifier not corresponding to the vehicle, or designs other than those prescribed by the competent authority.
  2. Failing to carry out the corresponding procedure of the vehicle with the National Registry of Vehicles and Drivers.
  3. Operating vehicles which are not covered by existing insurance policies under this Act.
  4. Driving vehicles exceeding the limits allowed by the rules on pollution from mobile sources or noises, the latter are produced directly by the vehicle or its occupants.
  5. Providing the service of land freight transport in all its forms, in days or hours not allowed.
  6. Provide related services without being licensed under this Act and its Regulations.
  7. Public service charge fees for inland transport of passengers not established by the competent authority.
  8. Exceeding the collection of fees by type concept vehicle towing or parking service for the custody of vehicles processed by the order or administrative authorities.
  9. Persons required under this Act and the Regulations to notify the divestiture of vehicles from the National Registry of Vehicles and Drivers.
  10. Parking where prohibited by the Rules of this Act or in areas demarcated and marked for emergency vehicles and equipment and prevention, or obstructing their access.
  11. Use in places intended for the placement of the nameplate, distinctive plates or unauthorized or which obstructs the visibility of them.
  12. Use on vehicles classified as non-emergency, lights, sirens, audible signals or other devices for suspecting this is an emergency situation, confusing and misleading to other users and users of public roads.
  13. Transporting children under ten (10) years of age in the front seat of the vehicle.
  14. Unauthorized reserve road space for personal or commercial.
  15. The excess of people in the service of private and public land transport of passengers on routes established by the Regulations of this Act.
  16. Drivers and motorcycle riders should not:
    • Move along or parallel channel to another moving vehicle, over sixty miles per hour (60 kph).
    • Move frequently changing channel or going either to the center, left or right of the track.
    • Carry more than two (2) people.
    • Carry cargo weighing more than ninety pounds (90 kg), unless they are specially built for it.
    • Carry cargo or objects whose volume interfere with operating the vehicle.
    • Move along or park in areas designated for pedestrians or other non-motorized modes.
    • Conduct against traffic.
    • Not use helmets or shielding.

Single paragraph: Until the competent authority in the matter sets an exclusive channel for the movement of bikers on motorways and fast roads, they must pass through the rightmost lane. Those who contravene this provision shall be punished with five tax units (5 UT), according to the provisions of this Article.

Mild Sanctions

Article 171. Shall be punished with fines of three tax units (3 UT), subject to the penalties provided in this and other laws, those who commit the following offenses:

  1. Operating vehicles with expired license or professional degree, or not carry upon being required by the competent authority.
  2. Driving vehicles with expired Integral Health Medical Certificate, or upon being required to port by the competent authority.

Violations of the rules under this Act, its regulations or resolutions issued by the ministry of people’s power operating in the field of land transport, related to general and special regulations of vehicles and pedestrians, which do not have a penalty expressed, shall be punishable by fines of three tax units (3 UT).
