Types of Temporary Contracts
Eventually Contract
This contract is used when a company has a need for timely production, such as an accumulation of work. It lasts for a maximum of 6 months within a 12-month period. Collective agreements may specify the number of these contracts allowed per company.
Temporary Replacement Contract
This contract covers temporary absences of permanent or temporary employees. There are two common types:
- Substitution: Covers an employee on leave, such as maternity leave. The contract duration is typically the same as the leave period.
- Vacante (Vacancy): Fills an empty position while a permanent replacement is being sought. The selection process should take a maximum of 3 months.
Insertion Contract
This contract is specifically for public administrations and non-profit organizations. It’s aimed at unemployed individuals and focuses on works or services of general interest and social development. It cannot be renewed and its duration depends on the work or service being provided.
Contract Formats
Work Experience Contract
This contract is for students with a degree or higher qualification. The job must be related to their field of study. The contract duration is between 6 months and 2 years, with possible extensions as long as the maximum duration is not exceeded. Employers benefit from reduced remuneration costs during the contract period.
Training Contract
This contract is for individuals without qualifications, typically between 16 and 21 years old. It allows them to acquire knowledge of a trade. The contract combines practical work (85%) with theoretical training (15%). The minimum wage is adjusted to reflect the reduced working hours. The contract duration is between 6 months and 2 years, with possible extensions up to 3 years.
ETT (Temporary Employment Agencies)
ETT’s can offer temporary contracts for specific projects or to cover temporary needs. The worker’s wage is determined by the collective agreement for the relevant sector. ETT’s are responsible for worker safety and the company using the worker has the power of direction.
